Desilets Technical & Design requires you to read and to agree to the following terms in order to work with you. These terms apply before and during project development, in addition to any and all project agreements. While terms are subject to change at any time without notice, changes made after labor on your project begins will not be affected by subsequent changes.

SERVICE & SATISFACTION
Desilets Technical & Design is committed to provide you professional service, efficient communication, and complete product satisfaction. I want you to be 100% satisfied with your final product, and I will work with you until you are 100% pleased. Because of this, all payments/deposits are non-refundable, except as noted in #7 below. I do not perform speculative work. Each web project is custom-designed to work on the most current and popular web browsers (such as IE7, Firefox, Opera) using valid CSS/XHTML markup. If you are using an old browser, I recommend that you upgrade immediately.

PRIVACY POLICY
Your privacy is important to me. To better protect your privacy,  I provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.  This notice applies to all information collected or submitted to Desilets Technical & Design, through the website, email, telephone, or postal mail.

I will not sell or distribute customer email addresses, but do reserve the right to be able to contact users concerning News, Specials, Updates and Changes.  All details concerning client contact information or payment information is held in strict confidence.  Desilets Technical & Design does not retain client payment information, and such information is digitally "shredded" from my computer systems..

SERVICE RESTRICTIONS
I am strict about acceptable content because of my commitment to providing reputable professional work to businesses and to individuals.

     My services exclude the following:

• Sites that promote any illegal activity
• Sites with morally objectionable content
• Sites that may be damaging to Desilets Technical & Design
• Any site that is deemed to be harmful to my subscribers, visitors, operations, reputation, goodwill, or customer relations.

WEBSITE DETAILS & COMMUNICATION
It is extremely important that you are clear with your needs so that I can make a quote  and meet your needs as accurately as possible. You must provide all written content to be applied to your page.  Please give as much detail as you possibly can. This is very important to ensure your product satisfaction. Email communication is preferred on important matters.  By email, both parties keep a record of all correspondence to avoid potential issues and miscommunication. It is the responsibility of the client to clarify all possible confusion to avoid miscommunication. If you do not understand something, please ask me to further explain.Telephone communication is available during business hours and also most early evenings.

DESIGN PROCESS, DEADLINES & TURNAROUND TIME
Desilets Technical & Design will work hard to meet your estimated deadline, but there are no absolute guarantees. Please be aware that many projects can take weeks to be completed, depending on the complexity of your request and my overall workload. The sooner you provide me with all needed content/pictures/details etc. necessary to complete your project, the sooner you will receive your project. Communication is crucial and imperative for timely delivery of your project.

While the development varies with each project, my most common 4-step design process is as follows:

1. After initial deposit, I begin website installation & setup.
2. You approve or disapprove the design. I make changes in template and/or design until you are absolutely happy with the look and feel.
3. At this stage you will submit all revisions based on text/verbiage and any and all graphics within the site itself. Additional layout changes can also be made. Additional features are also added.
4. Revisions are made.  Your site goes live*. 

* NOTE:  Occasionally for new websites, I implement the RAPID DEPLOYMENT PLAN.  In this plan, the site goes live early with the prioritized content, and I continue development.  

PAYMENT SCHEDULES / PLANS
Client may set up a payment plan with me, as long as it is reasonable for both parties, and is honored 100%. I typically require a 50% deposit of the project total before I start work.  Jobs with a total estimate of $400 or less must be pre-paid in full.  For some projects, I offer several different payment plans that I will explain to you individually.

I start your project as soon as you make the first deposit and send all necessary materials/content to me. Each payment dictates the progression of your project. If you delay a payment, your project will be delayed because I will not be able to progress to the next step.

Because Desilets Technical & Design is also busy with many other clients, it is the responsibility of each client to maintain constant communication.. I provide service on a first come-first served basis.  If you need a project completed that will require me to put other clients’ projects on hold, I must charge a RUSH and/or INCONVENIENCE FEE (see #10 for details). I will quote this fee to you individually. Desilets Technical & Design’s normal business hours are 8 AM to 5 PM, but I am also available most early evenings.

EARLY TERMINATION  /  REFUND POLICY
If you terminate my services early, you will forfeit the benefit of my labor and any products as a result.  Desilets Technical & Design will retain all intellectual property delivered.  Early termination is a rare event, because my clients have a 99% satisfaction rating.  A typical case of early termination is that someone else has offered to complete the job.  If you are considering early termination, I recommend discussing the matter with me.

           REFUND POLICY

• Deposits and payments of $300 or less are nonrefundable.
• Deposits and payments over $300 may be partially refundable. Labor performed before the date of termination is billed at the hourly rate of $36.00.  You will receive a refund of unused labor.  If the unpaid labor amount exceeds the amount of the deposit or payment, you are liable for the unpaid labor and you will receive an invoice.
• *Extreme delays caused by Desilets Technical & Design.  While this has never occurred, I will issue a refund of the most recent deposit tendered if I am held accountable for delay of completed project after 30 days of last deposit or payment and Desilets Technical & Design is completely unreachable. For example, if the client sends in a second payment of 30%, and I am completely unreachable for 30 days, I will refund client that 30% payment. Again, this is because each payment dictates the progression of each step in this design process.
  
  * Such delays could be a result of, for example, personal crisis, illness, family emergency, death, etc. Client will be notified immediately of such delay beforehand if possible. This policy only applies if Desilets Technical & Design is 100% unreachable for 30 days. If client is causing delay of project, this policy will not apply, and no refund will be issued, except by the above terms.

WEBSITE CREDIT /  RIGHT TO DISPLAY
Desilets Technical & Design reserves the right to place a link on a client’s website on the Home Page, and/or the official Desilets Technical & Design logo on a particular graphic design piece. I will always ensure that if my logo is placed on your design or website that it will compliment your design. Removal of my link/credit is unacceptable and voids your project agreement. If you would like to pay extra to not have my logo/credit link placed on your work, I will quote you individually. I reserve the right to display all works in my portfolio.

TRAINING, MAINTENANCE FEES & PAYMENT
Training of website editing and maintenance is typically included for every client. I also normally provide technical support for one year from date of launch. The exceptions is the development of a discounted website, either through a promotion or a negotiated discount for a project that is deemed worthy and demonstrated financial hardship. 

While I design websites that can be maintained by the customer, maintenance options are available. Maintenance fees vary upon the project and are applied for web, graphic, and multimedia/flash updates. For your convenience, I will send you the lowest estimate for your particular project. You are to pay the estimate in full in advance. In the event that I underestimate the time spent on your project, I will notify you before I have to proceed. You have the right ask me to stop if you do not want to go over the estimated time. In the event I proceed with your project upon your approval, you are required to pay the remaining balance in full within 72 hours or 3 (three) full business days. Desilets Technical & Design reserves the right to forfeit any work that has not been paid under these conditions.

RUSH & INCONVENIENCE FEES
All Rush and Inconvenience fees vary upon the project. Websites that are completed from my end and then requested to change fully, will incur an inconvenience fee. Project fees will vary. Desilets Technical & Design will determine the exact price of these fees and the deadline for payment. Client is responsible for paying these fees in accordance with the agreement made. Desilets Technical & Design reserves the right to forfeit any work that has not been paid under these conditions.

Please consider that with any rushed deadline, you are forcing me to delay other projects to accommodate to your needs, which causes an inconvenience for my other clients. Rushed work comes with risks. Your project quality may not be up to par due to the limited time for creativity.  I have the right to reject any rushed project if I feel it will risk the integrity and quality of my performance.

HOSTING
If you have an existing Linux hosting plan technically acceptable for the new website, I will require full access to the hosting account.  For new sites or if there is a technical requirement to obtain new hosting, I will assist you in obtaining the new hosting account.  While many web developers resell hosting for additional profit, I do not profit from this.  I want my clients to enjoy quality hosting at a good price.  I am a GoDaddy Affiliate, and I am able to offer their hosting at a discounted price.

PAYMENT METHOD
Desilets Technical & Design accepts all major credit cards, and checks via Paypal. Please note that I will begin work on your project when I receive the initial deposit.. You do not need to have a Paypal account to make payments. If these payment methods are a problem, please contact me first via phone at 206.824.5110, email, or Live Support chat on my website.

I will provide you with invoices for each payment made.  Alternatively, you may receive a single final invoice at your discretion. You are required to pay your final invoice within 10 days from receipt.

FAILURE TO PAY / OTHER LEGALITIES
Desilets Technical & Design reserves the right to withhold any and all works until 100% of invoice is paid in full. Failure to pay will result in complete loss of work performed after any initial invoice. A 10% interest fee will be applied to any and/or all individual projects every 30 days of non-payment. Further details will be explained on your individual project agreement, which will be sent to you. Desilets Technical & Design reserves the right to terminate a project at any time.

Desilets Technical & Design has the right to pursue legal action in an attempt to collect outstanding debts. Unprofessional conduct (including harassment, profanity, discrimination, threats of any kind, slander and any other unethical behavior) can and will result in complete forfeit of project and refunds. Failure to comply with each term of service can result in pursuance of legal action.   Email correspondence can change the legal terms of our contract.

These Terms are enforced with each individual project.
